Form descriptions – Standard refund – Finnish equities

The following is a list of information regarding the various tax forms to be completed in order to benefit from standard refund of withholding tax on income from Finnish equities. The templates of the forms are available on our Tax Forms to use section.

Form VEROH 6161e Certificate of Tax Treatment concerning Dividends from Finland

This form is for use by European Economic Area (EEA) resident beneficial owners.

If this form certifies that the dividends are not taxable in the taxpayer’s country of tax residence, then relief at source will be available as necessary; the form is then valid until revoked.

If this form certifies that the dividends received in the specified year have been taxed as income, then only quick refund or standard refund are available and the form is valid for that year only.

When is it provided?

At the latest four months before the statutory deadline.

Form VEROH 6163e Application for Refund of Finnish Withholding Tax on Dividends (Non-individual Applicant)

This form must be used for reclaiming withholding tax on Finnish dividends by beneficial owners that are not individuals but are, for example, corporate entities or funds.

Who completes it?

Beneficial owner.

How often is it provided?

Per reclaim application.

When is it provided?

At the latest four months before the statutory deadline.

Copy or original?

Original required.

Form VEROH 6164e Application for Refund of Finnish Withholding Tax on Dividends (Individual Applicant)

This form must be used for reclaiming withholding tax on Finnish dividends by beneficial owners that are individuals.

Who completes it?

Beneficial owner.

How often is it provided?

Per reclaim application.

When is it provided?

At the latest four months before the statutory deadline.

Copy or original?

Original required.

Form VEROH 6167e Specification of dividend payments for which refund is being requested

This form is mandatory to use if the reclaim request is related to more than one dividend payment.

For individuals, the accounting period field should be left empty and for non-individuals, the dividends reclaimed must all relate to the same accounting period (the one indicated in fields 1.2 - 1.3).

How often is it provided?

Per reclaim application.

When is it provided?

At the latest four months before the statutory deadline.

Original required.

Certificate of Exemption/Tax-at-source card

Confirmation from the Finnish Tax Authorities that they recognise the beneficial owner as a tax-exempt organisation.

How many are provided?

One per beneficial owner that is a tax-exempt organisation.

Who completes it?

Finnish Tax Authorities.

How often is it provided?

Once; valid until revoked or as stated in the tax exemption letter/ Tax-at-source card.

When is it provided?

At the latest four months before the statutory deadline.

Copy or original?

Authenticated copy required.

Certificate of Residence

A Certificate of Residence with the beneficial owner’s full name and address, issued by the beneficial owner’s tax authorities

Note:

VEROH 6164e: For individual applicants, VEROH 6164e can be certified by the local tax authorities instead of including a separate Certificate of Residence.

Tax-at-source card: A Tax-at-source card (TASC) issued by the FTA can be submitted for tax reclaim applications instead of a Certificate of Residence (COR), under the condition that the TASC:

  • confirms the beneficiary’s eligibility for a reduced tax rate/tax exemption on Finnish dividends; and
  • states the same tax year mentioned on the tax reclaim application form(s).

With the reclaim request

Original required (Tax-at-source card may be submitted as a copy).

Power of Attorney

If the client or a third party is completing a form on behalf of the beneficial owner, a Power of Attorney must be provided.

In addition, it is required that the full intermediary chain is covered with power of attorneys, when submitting Finnish standard applications via Clearstream Banking, as follows:

The beneficial owner is the LuxCSD client:

  • One POA issued by the beneficial owner (the LuxCSD client) to LuxCSD.

The beneficial owner is a direct client of the LuxCSD client:

  • One POA issued by the beneficial owner to the LuxCSD client, with whom the beneficial owner has their account; and
  • One POA issued by the LuxCSD client to LuxCSD.

The beneficial owner is an indirect client of the LuxCSD client:

  • One POA issued by the beneficial owner to the intermediary bank, with whom the beneficial owner has their account; and
  • One POA issued by the intermediary bank, with whom the beneficial owner has their account to the LuxCSD client; and

One POA issued by the LuxCSD client to LuxCSD.

Beneficial owner, intermediary bank and Clearstream Banking customer, as applicable.

How often is it provided?

Per reclaim application.

When is it provided?

At the latest four months before the statutory deadline.

Copy or original?

Original or authenticated copy required.

Credit Advice

Identifies dividend payment details including the security type, gross amount of payment, date of payment and amount of tax withheld. The credit advice must reconcile with the information in the refund form. 

Furthermore the full chain of credit advices is required as proof of payment from LuxCSD to the final beneficial owner. This means that, if the beneficial owner is the client’s underlying client, the credit advice from the client to the beneficial owner must be provided in addition to the LuxCSD credit advice.

Letter of Request to LuxCSD for reclaim of Finnish Withholding Tax
