United Kingdom and Ireland: Changes to the SDRT/Stamp Duty adjustment and SDRT ECJ ruling case reclaim forms

18.12.2013

Effective

1 January 2014

changes will be implemented in the UK and Irish forms for requesting an adjustment of stamp duty reserve tax (SDRT) or stamp duty and reclaiming SDRT (ECJ ruling case) to include a unique 18-character reclaim reference, in the format nnnnn-yyyymmdd-ccccc where:

nnnnn is the customer’s five-digit account number;
yyyymmdd is the date of submission of the request to Clearstream Banking1; and
ccccc is a unique customer-defined alphanumeric code (for example, a sequence number).

Example: A first request for customer account 12345, submitted on 15 January 2013 might look like this: 12345-20130115-00001

This unique reference must be used in any exchange of information related to such requests/reclaims and will be quoted in the final approval/rejection of each reclaim.

Note: The final status of the reclaim (approval or rejection) will be communicated to the customer by a free-format message and no longer via fax notification.

Impact on customers

Customers must ensure that, after 1 January 2014, any forms or other communication sent to Clearstream Banking with regard to an adjustment of SDRT / Stamp Duty or a request for refund of SDRT (ECJ Ruling Case) must contain the respective unique reclaim reference.

Note: We provide, as an attachment to this Announcement, a non-exhaustive list of clearing services and/or depository receipt systems so that, when completing the form, customers can check whether their counterparty comes under one of the categories or not and thereby be better able to choose the appropriate option in the form.

Further information

The related tax forms to use will be updated accordingly and presented on the Clearstream website from 1 January 2014, when they will be valid. Examples are attached for information purposes and should not be used.

For further information, customers may contact Clearstream Banking Customer Service or their Relationship Officer.
