Finland: New tax reclaim forms published by the Finnish tax authorities

Clearstream Banking1 would like to inform customers that the Finnish Tax Authorities (FTA) has released the below attached new application forms for reclaiming withholding tax on Finnish dividends, effective

 immediately

This follows the government proposal (HE/ 29/2016), currently pending approval. Customers are requested to already start using the new forms with immediate effect and this will be mandatory from 1 July 2017, once the law has been passed.

The new forms include the following new requirements:

Individual applicant (VEROH 6164e) and Non Individual applicant (VEROH 6163e) forms

  • Amount of tax withheld or requested as refund
    The updated forms include EUR amounts (field 5.14 and 5.15). Customers are requested to not use any commas or dots in these sections.
  • Refund request for several payments
    If the reclaim is related to more than one dividend payment, then box 5.17 (for non-individuals) or box 6.14 (for individuals) should be ticked and the further reclaim details should be completed on the new form VEROH 6167e.
  • Certificate of residence
    The name of the applicant in field 1.1 and the tax ID in field 1.13 must be filled in exactly the same way as in the Certificate of Residency (CoR).
  • Sections 2 and 3
    With the exception of field 2.12, which must be ticked if the application is signed by any party other than the applicant, customers are reminded to leave sections 2 and 3 blank since Clearstream Banking will complete these.

Specification of dividend payments for which refund is being requested (VEROH 6167e)

  • If the reclaim request is related to more than one dividend payment, this new form is mandatory to use by all applicants;
  • For individuals, the accounting period field should be left empty; and
  • For non-individuals, the dividends reclaimed must all relate to the same accounting period (the one indicated in fields 1.2 – 1.3).

Impact on customers

The current versions of the application forms VEROH 6164e and VEROH 6163e remain valid. However, customers are requested to already start using the new forms with immediate effect and to note that these forms become mandatory from 1 July 2017, once the law has passed.
