Poland: New Power of Attorney
Effective
1 January 2014
new templates of Power of Attorney must be submitted by the owners of Polish securities in favour of Bank Handlowy w Warszawie SA (Bank Handlowy), our depository in Poland.
Impact on customers
Based on the request received from Bank Handlowy, customers have the following possibilities:
- If no Power of Attorney has previously been submitted by the final beneficial owner, the new templates must be used.
- If a valid Power of Attorney has previously been submitted, the final beneficial owner can:
- Replace the former Power of Attorney with the new templates; or
- Maintain the previously submitted Power of Attorney and submit an Authorisation to Disclose Information.
Please note that there are two new templates of Power of Attorney, one for refunds linked to income paid after 15 May 2012 (Power of Attorney – Omnibus Account) and one for refunds linked to payments made before 15 May 2012.
All the above-mentioned documents must be notarised and apostilled. Furthermore, they must be submitted once and will remain valid until revoked by the final beneficial owner or by Bank Handlowy.
The new Power of Attorney templates are available on our website and have replaced the previous templates.
